You may want to take note that in COMMONWEALTH of Pennsylvania v. Stacey L. TANNER, AppellantNo. 650 MDA 2012, 2013 WL 563336, 2013 PA Super 24 (Feb. 15, 2013), the Superior Court has reaffirmed the principle that, for sentencing purposes under Pennsylvania’s merger doctrine, 42 Pa.C.S.A. § 9765, a defendant’s DUI conviction merges with both her  homicide by motor vehicle while DUI and aggravated assault by vehicle while DUI convictions (75 Pa.C.S.A. §§ 3735(a)3735.1(a), and 3802(c), respectively).
