A blog of the Philadelphia Bar Association’s Criminal Justice Section

Happy Holidays everyone.

Attached please find the new MC and CP schedules effective January 2015 as well as new bail rules.   Effective February 9, 2015, Rules of Criminal Procedure 528 and 535 are amended.

The first amendment permits bail to be posted by the defendant or another person.  And the ‘other person’ can avoid financial liability if the defendant skips bail by posting bail in the defendant’s name.  More details are attached.  The second amendment allows for the court to direct the bail money to be utilized to pay for restitution, fines, costs and fees at the final conclusion of the case.    I hope the information is useful.

I hope to see all of you at the upcoming holiday party on December 18.

James A. Funt, Esquire, Co-chair-elect
