A blog of the Philadelphia Bar Association’s Criminal Justice Section

February 17, 2016

As you may have heard, Philadelphia is moving forward with programs for Treatment Court and an Intermediate Punishment Program for multiple DUI offenses.  Attached to this email is a summary outlining the eligibility requirements as well as the  terms for 30 day, 90 day and 1 year cases. Also included with this email are  the sanctions imposed for violations and the colloquy required.  These programs have been negotiated in good faith by all the relevant court players,  Judge Neifield, the District Attorney’s Office, the Defender Association of Philadelphia, as well private attorneys represented by PACDL members and the Criminal Justice Section of the Philadelphia Bar Association.  The programs will be up a running very soon and I suggest that you familiarize yourself with the protocols.  The programs provide a substantial benefit for many clients in the appropriate cases and you need to understand the requirements and limitations to effectively represent your clients.
